Terms of Service

These Terms of Service (“Terms”) govern your access to and use of cincinnatipromo.wellnessdocs.com and the online benefits-check funnel offered by Wellness Docs, LLC (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms supplement our master Terms and Conditions at wellnessdocs.com and are specific to this Service. In the event of any conflict, the master Terms control.

1. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent that you meet these requirements and have the legal capacity to enter into a binding agreement.

2. What the Service is

The Service is an online intake form that allows you to (a) provide your contact information, (b) provide your insurance information so Wellness Docs can perform a complimentary verification of whether your insurance plan covers certain services we offer (a “benefits check”), and (c) request an appointment through our scheduling partner.

3. The benefits check is informational, not a guarantee

A benefits check is an informational estimate based on what your insurance carrier reports at the time of the check. It is not a guarantee of coverage, payment, or eligibility. Final coverage and payment depend on:

• The terms of your specific policy on the date of service;
• Medical necessity determinations made by your carrier;
• Your deductible, copay, coinsurance, out-of-pocket maximum, and plan year status;
• Any pre-authorization requirements your carrier may impose;
• The actual services rendered and how they are coded and billed.

You remain responsible for any amounts your carrier does not pay. We strongly encourage you to verify benefits directly with your insurance carrier before any service is performed.

4. No medical advice

The Service does not provide medical advice. Nothing on the Site or in any communication sent through the Service is a substitute for professional medical evaluation, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with any questions about a medical condition. Never disregard professional medical advice or delay in seeking it because of something you read on this Site.

5. Booking and our scheduling partner

Appointments are scheduled through a third-party platform (Zenoti). Your use of that platform is governed by its own terms and privacy policy. Wellness Docs is not responsible for any acts, errors, or omissions of third-party platforms.

6. Communications and consent

• By submitting your contact information, you agree that we may contact you at the email address and phone number you provide for purposes related to your benefits check, appointment, and care options.
• If you opt in to SMS, your continued participation is voluntary and may be cancelled at any time by replying STOP. SMS consent is not a condition of receiving care or any other service.
• Your communications consents are described in more detail in our Privacy Policy.

7. Accuracy of information

You agree to provide accurate, current, and complete information when using the Service. Providing false information may interfere with our ability to provide accurate benefits results or care, and may result in additional charges to you that are not covered by insurance.

8. Intellectual property

The Site, including its design, text, graphics, logos, and software, is the property of Wellness Docs or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

9. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Submit information about another person without their authorization;
• Attempt to gain unauthorized access to any portion of the Service or to other accounts, systems, or networks;
• Interfere with or disrupt the Service or the servers and networks connected to it;
• Use any automated means (bots, scrapers) to access or collect data from the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT BENEFITS CHECK RESULTS WILL BE COMPLETE OR ACCURATE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WELLNESS DOCS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND VENDORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUES, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Wellness Docs and its owners, officers, employees, contractors, and vendors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including for any conduct that we believe violates these Terms or is otherwise harmful. The provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will survive.

15. Governing law and binding arbitration

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws provisions.

Informal resolution first. Before initiating arbitration or any court proceeding, the parties agree to attempt to resolve the dispute informally for a period of sixty (60) days. Written notice of the dispute must be sent to Wellness Docs, LLC, Attn: Legal, 3328 Princeton Rd, Fairfield Twp, OH 45011, or by email to info@wellnessdocs.com, and must describe the nature and basis of the claim and the relief sought.

Binding arbitration. Consistent with our master Terms and Conditions, if the dispute is not resolved within the 60-day informal period, you and Wellness Docs agree that any remaining dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively through final and binding arbitration administered by JAMS in Ohio under its then-current rules (see jamsadr.com), rather than in court. The arbitrator’s decision will be final and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and Wellness Docs each agree that disputes will be arbitrated only on an individual basis and that neither party may bring or participate in a class, collective, or representative action.

Court venue for non-arbitrable matters. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction located in Hamilton County, Ohio — specifically, the Court of Common Pleas of Hamilton County, Ohio, or the United States District Court for the Southern District of Ohio — and you consent to personal jurisdiction in those courts for such purposes.

16. Changes to these Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a new “Effective date.” Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

17. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Wellness Docs regarding the Service.
